The motivations behind criminal policy legislation are, on the one hand, a public opinion that requires increased security and, on the other, a scholarly doctrine concerned with the protection of human rights in front of the legal system and the penitentiary administration. The latter motivation is by far the strongest and most constant; the former inspires sporadic bouts of repression.
