Acceptance of Terms

To be authorized to place orders on www.cairn.info or www.cairn-int.info, you must first review and accept these General Sales Terms and Conditions, which you may print by clicking on the “print" button of the browser or by choosing “print" in the file menu.

By completing and submitting the order form, it is understood that the purchaser accepts, without reservation, these General Sales Terms and Conditions presented below, as well as the Privacy Policy.

Available Products and Services

CAIRN.INFO SAS sells several types of products and services via its website www.cairn.info:

  1. the purchase of a right to access a particular article (pay-per-view) for certain articles,
  2. the online purchase of a print journal that may be accompanied by a right to access all of the articles in the purchased title,
  3. the online purchase of a journal subscription.

The purchase of a global access license to all of the items on the website www.cairn.info or www.cairn-int.info is subject to a specific contract negotiated separately between the client institution or establishment and CAIRN.INFO SAS.

Purchase of the Right to Access an Article

1 – Ordering Process

Any purchase of a right to access an article through the CAIRN.INFO SAS websites (www.cairn.info, www.cairn-int.info or other subdomain) is deemed final upon completion of successive steps when the user confirms the order.

2 – Order Fulfillment

CAIRN.INFO SAS undertakes to provide immediate access to the article purchased by the user. The right to consult an article is accompanied, for certain content (at the election of those holding the rights), by the right to download the article in PDF format. The user acknowledges that CAIRN.INFO SAS is not responsible for any damage or any permanent or temporary problem caused to the data or computer equipment of the customer when downloading files from the website www.cairn.info or www.cairn-int.info. In particular, the company CAIRN.INFO SAS is not responsible for the possible transmission of viruses through its website.

3 – Proof

The data saved by CAIRN.INFO SAS is proof of all transactions made by CAIRN.INFO SAS and its customers.

Data saved by the payment system of CAIRN.INFO SAS is proof of the transactions.

4 – Offer and Price

All of the articles available on the website www.cairn.info or www.cairn-int.info are described in good faith and as accurately as possible. Nevertheless, in the case of a discrepancy between the description and the product, the content descriptions offered on the website originate from the journals themselves and therefore cannot engage the liability of CAIRN.INFO SAS.

The offers and prices are valid the day the website is consulted; they can be changed without notice.

The prices offered at the end of the order process indicate the total price and include the French VAT.

Prices are listed in euros.

5 – Billing

For every purchase made, the user receives an email invoice from Cairn.info or en.cairn.info.

6 – Payment

Orders to access articles through the CAIRN.INFO SAS websites are payable uniquely by credit card via a secure server. CAIRN.INFO SAS reserves the right to block any transaction exceeding 1,500 € or all total orders exceeding the daily limit of 2,500 € for the same user. A request for authorization will be made to your financial institution at the time of the order.

Purchasing an Issue or an Annual Subscription to one of the Journals Offered on the cairn.info Website

2 – Order Fulfillment

CAIRN.INFO SAS is bound by the order that the purchaser places from the date the invoice is sent, or acknowledgement of receipt of the order confirming the agreement of CAIRN.INFO SAS to process it.

3 – Proof

The data saved by CAIRN.INFO SAS is proof of all transactions made by CAIRN.INFO SAS and its customers.

Data saved by the payment system of CAIRN.INFO SAS is proof of the transactions.

4 – Offer and Price

All of the articles available on the website www.cairn.info or www.cairn-int.info are described in good faith and as accurately as possible. In the case of an order from a country outside of the European Union, the buyer is the importer of the concerned product(s). For all products sent outside of the European Union and the French Overseas Departments and Territories, the price will be automatically calculated on the invoice excluding tax.

Customs duties, other local taxes or import duties or government taxes may be due. These duties and amounts are not the responsibility of CAIRN.INFO SAS. They are paid by the buyer and it is the buyer’s responsibility to declare and make payments to authorities and/or the competent institutions of the buyer’s country. CAIRN.INFO SAS recommends consulting the competent local authorities for information on these issues.

The prices offered at the end of the order process indicate the total price and include delivery fees and, if applicable, the VAT.

5 – Availability

The product offerings and prices of CAIRN.INFO SAS are valid as long as they are visible on the websites, subject to availability.

In the case of unavailability of an article, the buyer is informed as soon as possible by email or mail.

The buyer who is informed that a product is unavailable may cancel the order by contacting customer service.

In any event, CAIRN.INFO SAS cannot be held liable for damages resulting from the unavailability of an article.

6 – Billing

For every purchase made, the user receives an email invoice from Cairn.info.

7 – Delivery Timeframe

CAIRN.INFO SAS will ensure that the order is processed as soon as possible. CAIRN.INFO SAS cannot, however, be held liable for any delays in order processing or delivery.

Should an order not be honored within thirty days of confirmation, the buyer may cancel it, at no cost, as long as the buyer notifies CAIRN.INFO SAS of such cancelation by email, fax, or registered mail.

Amounts that the buyer has already paid will then be reimbursed within thirty days of the date of the request for reimbursement. Should articles be delivered on different dates based on their availability, the delivery will be based on the longest timeframe. Nevertheless, CAIRN.INFO SAS reserves the right to split shipments.

Indicated delivery timeframes are average timeframes and correspond to processing and delivery times for products delivered within Belgium.

8 – VAT

Prices indicated on the website include the Belgian VAT. This is due for all consumers not subject to the VAT who reside in or have their headquarters in a European Union country. It is also due for consumers subject to the VAT who are headquartered in Belgium.

Consumers subject to the VAT who are headquartered in another country in the European Union and who wish to have a delivery sent to that country, as well as consumers from countries outside of the European Union have the option to be billed without tax. To do this, they must communicate their request to CAIRN.INFO SAS by email, fax, or registered mail. It is their responsibility to declare the import in compliance with the fiscal regulations of their country of residence.

In any event, consumers subject to the VAT are required to declare their VAT number on the order form. CAIRN.INFO SAS reserves the right to suspend an order if this information is not communicated or if the transmitted number proves to be incomplete or wrong.

9 – Shipping Fees

Shipping fees that the buyer may possibly incur are communicated, online, at the time of order.

Delivery fees are borne by the buyer and are added to the price of the ordered product(s) and included in the invoice.

If CAIRN.INFO SAS splits the order for reasons of availability, the processing and delivery fees will be charged for a single delivery.

10 – Damages and Losses

Pursuant to the Belgian law of July 14, 1991 on trade practices and consumer protection, the burden of damages or losses rests with the remote seller.

Thus, if the received product does not correspond to the item the buyer ordered or if it is damaged, it is possible for the buyer to return it to CAIRN.INFO SAS within seven days of receipt. CAIRN.INFO SAS will exchange the product or reimburse the amount of the order, as well as shipping fees, within thirty days of receiving the returned item. However, CAIRN.INFO SAS reserves the right to refuse to reimburse returned products if they are damaged by the buyer.

In general, an order will be deemed delivered within five business days of receipt of the items by the carrier responsible for delivery. If, however, one or more ordered products do not reach the buyer at the provided delivery address within thirty days of order confirmation, it is the buyer’s responsibility to contact CAIRN.INFO SAS, within a reasonable timeframe, to verify the status of the order.

In the event that the product that should have been delivered was misplaced during the delivery process, CAIRN.INFO SAS will make a new shipment or reimburse the amount of the order (including shipping costs of the first order).

11 – Right of Withdrawal

You have the right to withdraw from this contract without cause within fourteen days.

The withdrawal period ends fourteen days after conclusion of the contract.

If you asked to download your digital file during the withdrawal period as part of the order of a title, journal, or publication, or if you downloaded a file during the withdrawal period as part of a subscription, you lose your right of withdrawal.

To exercise the right of withdrawal, you must communicate your decision to withdraw from the contract to the address indicated below by means of an unambiguous statement (for example, a letter sent by post, fax, or email). You may, but are not required to, use the model withdrawal form made available to you below.

To comply with the withdrawal period, you need only send your statement exercising the right of withdrawal before the expiration of the withdrawal period.

12 – Effects of Withdrawal

EIn the case of withdrawal from the contract on your part, we will reimburse all payments received from you, including any delivery fees (except for supplementary costs arising from the fact that you chose, if applicable, a method of delivery other than the least expensive standard delivery option that we offer) without undue delay and, in any event, no later than fourteen days starting from the date that we were informed of your decision to withdraw from the contract. We will reimburse you using the same payment method that you used for the initial transaction, unless you expressly agree to a different method; in any event, you will not incur any additional fees due to this reimbursement.

13 – Payment

Orders for journals made through the CAIRN.INFO SAS website are payable by credit card, via a secure server, or by bank transfer. Subscriptions may be paid for by check.

CAIRN.INFO SAS reserves the right to block any transaction exceeding 1,500 € or all total orders exceeding the daily limit of 2,500 € for the same user.

In the case of a credit card payment, a request for authorization will be made to your financial institution at the time of the order.

Purchase of a Subscription or Journal on the www.cairn.info or www.cairn-int.info Websites

1 – Ordering Process

Any order placed through the CAIRN.INFO SAS websites (www.cairn.info or www.cairn-int.info and any other subdomain) is deemed final upon completion of successive steps when the user confirms the order.

2 – Order Fulfillment

On the date that CAIRN.INFO SAS sends the invoice or the acknowledgement of receipt of the order confirming the agreement of CAIRN.INFO SAS to process it, CAIRN.INFO SAS forwards the purchaser’s information to the relevant publisher or distributor. CAIRN.INFO SAS cannot be held liable for the delivery or the conformity of the purchased product, or any other obligation relative to a journal subscription. That is the sole responsibility of the publisher concerned.

The publisher concerned will establish all terms concerning the journal subscription.

1 – General Principles

The content or portions of the content offered on the websites www.cairn.info or www.cairn-int.info may be subject to annual access licenses subscribed to by institutions or establishments – notably libraries – for their users.

2 – Conditions

The conditions of such licenses are not negotiated online but are subject to a specific contract between the establishments or institutions and CAIRN.INFO SAS. For more information, contact:

3 – Rates

The subscription rates for these licenses may be indicated on the websites www.cairn.info or www.cairn-int.info, specifically in the “libraries” section. They are not, however, contractual in nature and are provided to users for informational purposes only. The final rates will be indicated by CAIRN.INFO SAS and defined by the contract offered to customer institutions or establishments.

General Provisions for all Types of Orders

1 – Proof

Notwithstanding other written evidence and all evidence stored on another durable medium to which the user has access, it is agreed that the computerized records, stored in CAIRN.INFO SAS computer systems of or its host, will count as proof of communication and order content between the parties.

2 – Intellectual Property Rights

The content of the website is protected by copyright. Copying, translating, modifying, or publishing all or part of it, in any form whatsoever, is prohibited without the prior written consent of CAIRN.INFO SAS. This is notably true for texts, commentaries, publications, illustrations, maps, and images available on this website, even if these are offered free of charge. Any infringement of these intellectual property rights may lead to civil and criminal prosecution.

3 – Disclaimer – Limitation of Liability

CAIRN.INFO SAS cannot be held liable for any damages whatsoever arising from the use of its website, including but not limited to, direct and indirect damages.

Notably, CAIRN.INFO SAS does not assume any liability for the content of websites with which it establishes hyperlinks, particularly with respect to the protection of privacy.

7 – Disputes

Any dispute relative to the use of this website will be exclusively governed by Belgian law. The courts and tribunals of Brussels will have sole jurisdiction in the case of a dispute.
