The advisory nature of the Council of State partakes of spoken and unspoken rules. What is legitimately expected, i.e. the analysis of the law and of administrative opportunity, goes together with the underlying, i.e. the support given to the government in different arbitrations as well as help in negotiations. This institution plays a major role as a moral authority in the governmental decision-making process. Yet, shouldn’t its consultative function, beyond this pleasant combination of political neutrality and legal expertise, express the determination of an institution at the service of the state?
