The volume of illicit downloads on the Internet poses a threat for the cultural industry because they represent a loss of authors’ rights. This paper analyzes the legal remedies allowed under French law for the illicit downloads of works protected by intellectual property rights. The responsibility of those involved, such as the Internet user or the access provider, is specifically addressed, along with what constitutes a permissible download, for example the private copy exception.
