Predictive justice seems to be based on a misunderstanding, i.e. that machines could replace humans only in cases where human intelligence brings little added value. This paper tries to distinguish such cases from other situations where artificial intelligence is the ally of the jurist and not his enemy, thereby stressing the important methodological choices to be made on the nature of judicial reasoning.
