Penal law ignores the notion of conflicts of interests. Consequently, provisions regarding conflicts of interests are not subject to penal sanctions and there is no general offense punishing such conflicts. However, the study of illegal taking of interests offenses indicates that these crimes have a very wide range of application, which allows for a widespread repression of conflicts of interests cases. It is, therefore, the lack of sensitivity to the notion of conflict of interests that explains why it is often said that such conflicts are subjected to insufficient penal repression.
