The treatment of legal problems within French companies has been studied within the framework of a mission entrusted by the Minister of Justice and the Treasury regarding certain factors that could reinforce the competitiveness of the Paris legal center. It has been noticed that in French companies the role of the law and of business lawyers was not as well acknowledged as in companies of equally developed countries. For instance, there is no protection of the confidentiality of counsel provided by lawyers to their management. this situation could be improved by the creation of a status of salaried company lawyers coupled with a ‘confidentiality privilege’ for the company counsel, similar to the dispositions adopted by our major partners.
