Linking the “rights” and the “legal personality” of nature is easy, yet potentially impairs the development of a grounded theory of the rights of nature. Indeed, there should be no deontic relationship between the recognition of the rights of nature and its legal personification. Such reasoning leads, by dint of abstract interpretations, to a naturalistic paralogism that transforms nature into a person. Another approach should be considered, less separatist, more inclusive, and more in keeping with the law: the “personification of an environmental commons.”
