father and taken the opportunity to offer various facets involved
in the overly general concept of the father function, the author
considers the various agents of that function in present-day
society and the reasons why he does not share the frequently
encountered pessimism concerning the decline of the father or the
father function. Finally, he develops the reasons that lead him to
designate the entire function, said to be paternal by Lacan, a
function of the «&#160;symboligène&#160;» (symbol-creative) third

three different answers to the question «&#160;why obey the
law&#160;?&#160;». We obey not only because the law is the law,
even if it is decisive, but also because of love or rather
attachment (in the sense of Bowlby) and by consenting or rather by
refusing violation. Disobeying in turn does not come only from a
pure desire of transgression, but also from the possibility of
creation and of resistance to injustice, from another obedience
then. It is only through these three dimensions that one can give

            <summary type="html"><![CDATA[AbstractPsychoanalysts tend to oppose «&#160;The Law&#160;» to
laws, implying thus that a transcendental agency, inherent in the
law in accordance with a supposed «&#160;symbolic order&#160;»
(which lapses into a moral order), could be objectified in the
unconscious and should therefore be respected, even copied by the
legislators. Now, psychoanalysis proves that there exists no such
psychic agency likely to indicate what is good and what is evil.
The Freudian metaphor of Oedipus, borrowed from Greek tragedies,
shows that the child must part from his mother and finds it
difficult to situate the barring principle which is the father or
his substitute&#160;: this is «&#160;The Law&#160;», indeed
necessary, yet a source of pathologies. We shall approach them
through two cases&#160;: an unintentional parricide child who is
the prey to a vengeful superego and another one who grew up under
enemy bombs but whose worst misfortune was having been the hostage
of his mother.]]></summary>

            <summary type="html"><![CDATA[Despite being faced with a general crisis in traditional norms,
statute-law has not lost its attraction, as evidenced by increasing
calls for legal regulation. In order to reinforce its legitimacy,
the legal system usually favours a rapid response which reassures
the public by concentrating on immediate and visible criminal-law
measures. Such responses give rise to a constant state of emergency
within the criminal law, and to the proliferation of exceptional
rules and derogations. This in turn weakens the symbolic resources
of the normal system of criminal justice, and causes a growing
divergence between the inflexibility of statute and the fluidity of
day-to-day practice. The visibility of a legal response thus takes
priority over its real substance. This discloses an inner truth of
the management-based model, in which statute-law – because it has
not been understood within the bounds of its own serious
limitations – turns back pathologically upon itself.]]></summary>

larger group dimension, has gradually accentuated its inherently
attractive potential for the child’s psyche. The Oedipus complex is
ultimately the realisation of an oedipal preconception constructed
in the encounter between the parental Oedipus complex and the
child’s own capacities for cathexis and identification. The
topography that emerges from the oedipal conflicts is the legacy of
a processualising movement of the object, the conclusion of the
transformation carried out by the cathexis/identification pair.]]></summary>

la pensée freudienne une origine commune à ces deux concepts et une
fonction identique, celle d’organiser le psychisme par rapport aux

mêmes racines et leur différence intéresse deux registres
distincts. Il s’agit pour le tabou de la limite entre l’humain et
son au-delà et pour l’interdit de ce qui dans le champ de l’humain,
organise le rapport du sujet à son semblable. Le tabou, en dehors
des sociétés primitives, serait-il alors seulement un élément de la
morale très personnelle de certains névrosés ? L’interdit est-il un
concept suffisant pour dire le poids symbolique d’un impératif
catégorique négatif premettant la structuration du surmoi ? &#160;]]></summary>

the metaphor of Genesis wherein God subtracts a part of Adam as a
phallic subtraction that regulates the sexual relation. On this
metaphor, the sexual law as a tie between the sexes is constructed.
While it has barely been elaborated, this interpretation is
readable, illuminating and laden with consequences. On its basis
one can reread Totem and Taboo beyond the murder of the father, and
from such a reading, question the origin of the interdiction of
incest in a new manner.]]></summary>
