La situation de l’animal s’est transformée au cours des dernières décennies. Il ne jouissait autrefois d’aucune protection. Un statut d’être sensible a récemment été reconnu aux animaux domestiques. Par contre, l’animal de chasse correspondait à une res nullius, c’est-à-dire qu’il appartenait à celui qui le capturait.
Le droit international s’est saisi de la question de la nature de l’animal, en mettant en place des dispositifs de protection.
La France a été influencée par ces textes, ce qui a conduit en 2015 à cette qualification d’« être doué de sensibilité » pour l’animal domestique. Pour l’animal de chasse, il y a eu plusieurs propositions de lois, afin de garantir une protection accrue. Quoi qu’il en soit, l’animal de chasse échappe encore aujourd’hui à cette appellation. Pourtant la chasse aux gibiers d’eau, le piégeage et l’interdiction de chasse pour des gibiers en mauvais état de conservation, montrent que l’animal sauvage peut être reconnu de manière implicite comme être doué de sensibilité.
L’évolution est lancée. On ne sait pas à quel moment elle pourra aboutir.

Hunting animal and sentient being
The legal status of animals has changed in recent years. Before there was no protection. Domestic animals have been recognized as sentient beings. However, hunting animals are regarded as res nullius which means that it belongs to the person who has captured the animal.
International law has take up the question of the nature of animals, setting up protective measures to protect them.
France has been influenced by international texts and in 2015 the domestic animal was qualified as a sentient being. For hunting animals, the situation is different. Several law proposals have been made to offer them a greater protection. But hunting animals escape from this appellation now.
However, waterfowl hunting, trapping and the ban on hunting game in a poor state of conservation show that wild animals can be implicitly recognized as sentient beings.
Evolution is underway, but we do not know when it will come to fruition.
